9th Circuit says prediction markets are gambling no matter what you call the contract. Same logic that gets pointed at everything onchain.

Nevada can regulate Kalshi's sports event contracts as gambling. Judge Ryan Nelson's line was basically that the label doesn't decide it, the substance does, it "is sports gambling, regardless of whether Kalshi calls them swaps."

Back in April the 3rd Circuit went the other way on the New Jersey case and said CFTC jurisdiction is likely exclusive. So two federal appeals courts now say opposite things, around 20 states are already litigating, and Kalshi says it'll seek review.
This ends up at SCOTUS.

The part I keep chewing on isn't Kalshi itself. Kalshi did every single thing people in this sub say you're supposed to do. Onshore, CFTC registered DCM, and the federal regulator was so much on their side it was suing states on their behalf. A state gaming board got them anyway, because the court looked at what the product does instead of what the filing calls it.

That is the same reasoning that's been pointed at tokens, at front ends, at "it's just software, we don't custody anything." Swap the nouns and it reads the same.
Even something as simple as a bitcoin casino can change its structure, payment rails or legal wrapper, but that doesn't necessarily change what regulators think the underlying activity actually is.

And Polymarket runs on the same structure now that it's back onshore through a licensed DCM, so I don't really see why the state angle stops at Kalshi.

If SCOTUS goes with the 9th, does prediction market volume just walk back offshore and onchain where it sat before 2025 or does the retail flow die because normies won't install a non-US app?
My guess is volume survives and the fee-paying US retail doesn't.
